Is there a way to appeal a denial of SSD benefits?

It is an unfortunate fact that no matter how badly a person in Killeen, Texas, needs Social Security Disability benefits, many people will have their initial applications for benefits denied. However, they should not lose hope. There is a four-step appeals process in place for those who want to challenge a denial of benefits.

Traumatic Brain Injury Symptoms

If you suspect you are suffering from a Traumatic Brain Injury ("TBI") after an accident, contact Michalk, Beatty & Alcozer, L.P., even if you haven't been diagnosed yet. If you are still under the care of a physician, but have not yet been diagnosed with traumatic brain injury, you may want to discuss your symptoms with your doctor so that you may receive a proper diagnosis. Symptoms may include:

Breath tests and "no-refusal" policies in Texas

If a driver in Texas is pulled over and accused of driving while intoxicated, the police may ask that the driver submit to a breath test to determine their blood alcohol content level. Drivers in this situation may be tempted to refuse to do so, for a variety of reasons. However, per Texas implied consent laws, there could be negative consequences that follow a breath test refusal, including the loss of a driver's license. That is because driving is considered to be a privilege and in exchange for the privilege of driving, a person must submit to a breath test if asked to.

When can a spouse in Texas seek alimony?

One issue that can come up in a divorce that can cause a lot of consternation is that of alimony, also known in Texas as "spousal maintenance" or "spousal support." After all, one spouse may be reluctant to pay any amount of money to an ex-spouse, while the other spouse may feel the need for financial support following a divorce, particularly if that spouse earned significantly less than the other, or stayed out of the workforce altogether to care for the family while married. In Texas, it is possible for a divorcing spouse to seek alimony, but only under certain circumstances.

Texas and Large Truck Accidents

Big rig accidents are a fairly common occurrence in the great state of Texas. Our state beats out the rest of the states in truck accident fatalities by surprisingly high margins. For example, in 2014, there were 532 fatal large truck accidents in Texas, representing a 14.2 percent rate. California, in the number two spot, experienced 281 truck accident-related fatalities, a 7.5 percent rate. Texas even holds the tragic distinction of the record holder for "highest number of large truck accident occupants killed," at 114. Oklahoma follows with a far lower 41 deaths.

How is 'disability' defined for obtaining SSD benefits?

Having a debilitating injury or illness can be difficult, physically, emotionally and financially. If a person in Killeen has a medical condition that prevents them from working, they may want to seek Social Security disability benefits. However, the Social Security Administration (SSA) has a very strict definition of disability for the purpose of obtaining SSD benefits. This is because SSD benefits are only available to those who are totally disabled, not those who are only partially disabled.
